Portrait Session Photography Agreement

Ready to book a session?  Awesome!   Before we seal the deal, please read over all of the following information.  It will answer many of your questions regarding our portrait sessions.  We require all of our clients to sign a Service Agreement prior to the session.  If you have any questions, please contact us using the link at the top of the page.


STEPS TO BOOKING A SESSION


STEP 1 - PICKING A LOCATION

We provide photographic services here at our studio or at the location of your choice. For a more personalized portrait session, we recommend picking a location that is special to you or your family. You might consider a local park or a favorite hang out. We also offer traditional portraits with backdrops. If you are choosing an outdoor location, please remember to check the weather. If choosing an indoor location, please provide adequate space to set up the necessary lighting equipment. Please note: Some locations require a permit, and you will be responsible for obtaining one if needed.  


STEP 2 - BOOKING A SESSION

You may call or text us at (803) 378-3698 to schedule your session, or you may schedule your session on our website. To schedule online, click here to Book A Session. Once your date, time, and location have been approved, we will contact you to let you know that we have reserved the requested date and time for you.  We do not usually require a booking fee for our portrait sessions, however if you book a session and cancel or reschedule your session more than once we will require a booking fee to reserve future sessions for you.           


STEP 3 - BEFORE THE SESSION

Prior to your session, we will swap ideas about the kind of images you hope to create during your session. We will discuss potential locations and recommend props if necessary. We will offer you helpful tips, and answer any questions you may have. We want your portraits to reflect who you are and what you love. Contact us if you need any help planning your session! 


DURING THE SESSION

During your session, we will work with you to create the amazing images you came for. You are welcome to request impromptu images.  If you want to try a shot over here or over there, or in front of this or in front of that, just tell us.  We LOVE special requests!  We don't want to miss a shot that may be important to you.  Please Be Aware: In very rare cases, some children will not cooperate. During moments like these, we will attempt to bribe them with loot from our treasure chest.  Don't worry, kids love us and most rock the camera on their own!!!  No matter what, we will reward all kids by letting them pick a few things from our treasure chest at the end of the session.  If you do not want your child to have something from our treasure chest please let us know in advance.


AFTER THE SESSION

You will be able to preview the images from your session within two weeks of your session date unless stated otherwise. We will notify you when they are ready for viewing. You may view your proofs in person or on our website. To view your proofs in person, you will need to schedule a viewing appointment. If you prefer to view your proofs online through our website, your images will be placed in a private password protected gallery. Proofs will be watermarked and/or labeled as such. They are for previewing purposes only. Printed proofs are available upon request for additional fee. After viewing your proofs, you will be able to purchase prints or products online or in person.  We accept cash, money orders, and all credit/debit cards.


PHOTOGRAPHY SERVICES AGREEMENT


Agreement Overview

This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties. If the Parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.


Coverage

The Client will submit a request for photography services at the date, time, and location of their choice.  All locations are subject to photographer approval.  Distance and safely will be considered.  Some locations require a permit, and the Client will be responsible for obtaining one if necessary.  If the requested date and time are unavailable, the Photographer will contact the Client to discuss alternate dates/times for the session.  Once a date, time, and location have been agreed upon, the Photographer will reserve the session.


BOOKING FEE

The booking fee, if required, is $25. The Photographer will notify the Client if a booking fee is required. If required, the Client must submit a payment of cash, check, or credit card made payable to "Crystal Kinard". The photographer will not reserve the Client's requested date, time, or location until the booking fee is received.  The session fee, when due, will be reduced by the amount of the booking fee.  In the even the Client cancels their session, the booking fee is non refundable.


SESSION FEE

The portrait session fee varies depending on the length of session requested. The session fee covers the photographer's time and talent, digital image editing, and a customized photo session at the location of your choice. No finished prints or products are included in the session fee. The session fee is due the day of your session before photographing begins and is non-refundable. Session Fees are as follows: Mini Session (15-30 Minutes) - $50, Full Session (1-2 Hours) - $100, Extended Session (2-4 Hours) - $250.


RESCHEDULING/CANCELATION FEE

A $25 rescheduling fee will be applied to all appointments if a 48-hour notice is not given. All cancellations and reschedulings must be made by phone, not e-mail.


Photographer Discretion

Client understands and agrees that Client is hiring the Photographer to perform Photographer’s services in Photographer’s own discretion and style. Client has no authority to control the manner in which Photographer takes photos. Client has no right to rescind this Agreement in any way if Client is not satisfied with Photographer’s photography.


Failure to Perform

Photographer will make a good faith effort to achieve Client’s desired results. However, Photographer will maintain ultimate discretion and control over the Session. Photographer will use the equipment that Photographer finds appropriate. Client’s desired results are limited by the terms of this Agreement. If at any time Client does not feel comfortable or wishes to cease the photography, Client may inform Photographer and end the session, at which time Photographer will stop photographing Client and end the session. The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to the Photographer will be used for organizational purposes only and in no way represent photography that will actually be produced. The Photographer will do its best to fulfill all requests but can make no guarantees all images will be delivered. 


Copyright

Title (possession) of and copyright to all products shall remain with the Photographer until client has paid in full. All photos are copyrighted. The negatives and or digital images (hereinafter collectively the “images”) created by the Photographer and/or subcontractor(s) remain the property of the Photographer. It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties.
Permission is herby granted to the Photographer to use any images created under this contract for professional samples, displays, internet pages, advertising, exhibitions, contests, and any other purpose. 
The Photographer retains the copyright to all images produced by the Photographer and/or the Photographer's subcontractors. If purchasing Hi-Resolution images on CD/DVD, Clients will be given a written release to make personal copies of images from CDs or DVDs. The client understands the images given on CD/DVD cannot be used for profit or advertising and all posting of images on the internet must be acknowledged as images by the Photographer.


Exclusive Photographer

The Photographer and/or any photographers hired by the Photographer to photograph shall be the exclusive photographer(s) retained by the Client for the purpose of the portrait photography. Family and friends of the clients and other event vendors shall not interfere with the Photographer’s duties. Guests will be asked to refrain from taking flash photographs at certain intervals of the event to ensure proper exposure of images. Expenses Travel expenses such as parking, shipping, or destination fees must be reimbursed to the Photographer and will be added to the balance due after the event. Travel fees are pre-determined and will be set out in the initial payment total. Clients are responsible for all location fees and permits. Event


Food Service

A light meal is required for events up to 6 hours for the Photographer. For events up to and past 8 hours a full course meal is required. If no meal is provided, it is understood that the Photographer will leave the event to purchase a meal.


Garments

The Photographer cannot be held responsible for damage to Garments due to environmental events. Client is responsible to arrange personal assistance for garments.


Creative License

Images are edited at the Photographer’s discretion, and delivered prints may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards.


Force Majeure

If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less retainer fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost 
through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Returned Checks Returned checks are subject to a $50.00 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by the Photographer in the event that enforcement of this contract becomes necessary. All legal action shall be taken appropriately. This is a contract for personal photography services to be provided by the Photographer and/or individuals subcontracted to do work for the Photographer. The Parties agree to the above and below terms and conditions, and acknowledge that they have received, read, and understand the Photographer’s current price list.
